What types of employment contract currently exist?

After the 2022 labour reform, the permanent (indefinite) contract is the general rule. Temporary contracts are limited to production circumstances and to standing in for other workers. There are also training contracts and the permanent-seasonal (fijo-discontinuo) contract.

Can I use temporary contracts in my company?

Yes, but only with justified cause (production circumstances or replacing a worker) and within the legal duration limits. Improper use of temporary contracts can turn them into permanent ones and lead to penalties.

Is it mandatory to register the contract?

Yes. Contracts must be reported to the public employment service (SEPE), as a general rule within ten days of hiring. Failing to do so may result in penalties.

What happens if I do not put the contract in writing?

Certain contracts must be in writing by law. Otherwise, they are presumed to be permanent and full-time, unless proven otherwise.
